Acceptable Use Policy

Last updated: 19 August 2026

This Acceptable Use Policy ("AUP") sets out the rules that all users of the NITELY platform (the "Service") must follow. By using the Service, you agree to comply with this AUP. NITELY ("we", "us", or "our") reserves the right to suspend or terminate access for any violation.

1. Permitted Use

The Service is provided to help nightlife promoters, teams, and agencies manage contacts, bookings, operations, and reporting. You agree to use the Service only for lawful business purposes related to your promotion activities and in compliance with all applicable laws and regulations.

2. Prohibited Conduct

You must not, and must not permit any person under your account to:

  • Use the Service to store, process, or share any data obtained without a lawful basis, including personal data collected without consent or in breach of data protection law.
  • Store or share any content that is unlawful, defamatory, harassing, threatening, or otherwise harmful.
  • Store or share content that infringes the intellectual property rights or privacy of any third party.
  • Attempt to gain unauthorised access to other Groups' data, the Service's systems, or any data not belonging to your Group.
  • Interfere with, disrupt, or place an undue load on the Service's infrastructure, including attempting to bypass security, rate limits, or tenant isolation controls.
  • Use the Service to send unsolicited marketing communications, spam, or phishing messages.
  • Introduce malware, viruses, or any other malicious code into the Service.
  • Reverse engineer, decompile, or disassemble any part of the Service, except to the extent permitted by law.
  • Resell, sublicense, or provide the Service to third parties without our written consent.
  • Use the Service to facilitate any form of discrimination, exploitation, or trafficking.

3. Contact Data and Consent

You are responsible for ensuring that any contact or guest data you enter into the Service has been collected lawfully and with appropriate consent. This includes contacts scouted in person, via social media, or through referrals. You must respect individuals' rights to have their data amended or removed upon request, and you must comply with applicable data protection legislation, including the UK GDPR and EU GDPR.

4. Group Administration

Group admins are responsible for the users they invite and the roles assigned to them. Admins must ensure that invited users are aware of these Terms, the Privacy Policy, and this AUP. Admins must promptly remove users who no longer require access to the Group.

5. Security Responsibilities

You agree to take reasonable steps to protect your account, including:

  • Using a strong, unique password for your account.
  • Not sharing your login credentials with anyone.
  • Notifying us promptly of any suspected unauthorised access or security breach.
  • Ensuring that your device and browser are kept up to date with security patches.

6. Monitoring and Enforcement

We do not routinely monitor the content you store within your Group, as your data is private and tenant-isolated. However, we may investigate suspected violations of this AUP and take appropriate action, including warning, suspending, or terminating accounts, removing data, and reporting to law enforcement where required.

7. Reporting Violations

If you become aware of any violation of this AUP, or if you believe your data has been misused, please report it to us immediately at hello@nitely.online. We will investigate all reports and take appropriate action.

8. Consequences of Violation

Violations of this AUP may result in immediate suspension or termination of your account and Group, without refund. Serious violations may be reported to law enforcement. You remain solely responsible for any data you enter into the Service and for any consequences arising from its unlawful use.

9. Changes to This Policy

We may update this AUP from time to time. Changes take effect when posted on this page with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated AUP.
